If Your Visa Has Expired

If your authorized stay has already expired you can try to apply for an extension.

On this point it is necessary to prove that:

• the delay was due to extraordinary circumstances beyond your control;

• the length of stay was reasonable;

• you did not do anything else to violate your non-immigrant status (remember: visitors cannot work in the United States);

• you are still a non-immigrant so nobody in your behalf can file an immigrant visa petition;

• you are not in formal proceedings for removal from the United States.
